VILLAGE SNOW/ICE REMOVAL LAW AND PROHIBITION AGAINST PARKING DURING SNOW EVENTS IS AS FOLLOWS:

CHAPTER 5 – Regulations for Streets and Sidewalks

Section 5. 2 – Duty of Residents regarding Sidewalks and Trees

Section 1. Purpose. The purpose of this local law shall be to preserve the public peace and good order in the Village of Cooperstown, and to contribute to the public welfare, safety and good order of its people and to contribute to the safe conveyance of its people over the streets and sidewalks of the Village of Cooperstown by establishing certain regulations for the removal of snow and ice from the streets and sidewalks of the Village, that are consistent with the nights and privileges of other residents of the Village of Cooperstown.

Section 2. Duty of Property Owner and Occupant. It shall be the duty of the owner and occupant, jointly, of every parcel of real estate adjoining a public sidewalk, whether the parcel of real estate is occupied by a structure or not, to keep such sidewalks adjoining such property free from snow and ice for the full paved width of such sidewalk. Property owners in the business district will be responsible for keeping a five (5) foot width of sidewalk free from snow and ice from the front of the building out to the sidewalk.

Section 3. Time Limit. Snow and ice shall be removed within twenty-four (24) hours after the end of a snowfall. In addition, sidewalks in front of commercial establishments and commercial parking lots shall be kept free of snow and ice at all times between the hours or 9:00 A.M. and 5:00 P.M.

Section 4. Severe Icing. In case snow and ice on any sidewalk shall be frozen so hard that it cannot be removed without injury to the sidewalk, it shall, within the time specified in Section 3, be strewn and kept strewn with ashes, sand, sawdust or other suitable material, so as to be no longer dangerous to life and limb. As soon as practical thereafter, the sidewalk shall be completely cleared of snow, ice and other materials strewn thereon, as provided in this local law.

Section 5. Removal by Village. Whenever the owner or occupant of a parcel of real estate adjoining a public sidewalk fails to remove the snow and ice from such sidewalk adjoining such property within the time specified in this local law or within four (4) hours after notice by the Superintendent of Public Works to remove same, it shall be the duty of the Superintendent of Public Works to remove said snow or ice from such sidewalk and notify the Village Treasurer of the expense incurred by the amount of labor, equipment and materials used. The charge shall be not less than the equivalent of one's hour wage for the highest paid hourly Village employee.

Section 6. Collection of Costs for Removal by Village. The Village Treasurer shall promptly present to the owner or occupant of each parcel a bill for the removal of snow and ice as certified by the Superintendent of Public Works. If not paid within thirty (30) days, the cost thereof shall be assessed against the property, added to their tax bill and become a lien thereon, collectible in the same manner as delinquent Village taxes.

Section 7. Snow, Ice and Water Falling From Buildings. The owners or occupants of buildings adjacent to public sidewalks shall take measures to protect the public from the falling snow, ice or water from such buildings.

Section 8. Depositing on Streets. No person, firm or corporation shall deposit, throw, place or strew, nor shall any person, firm or corporation cause to be deposited, thrown, placed or strewn, any snow or ice upon any street, avenue or roadway within the Village.

Section 9. Placing of Snow and Ice on Another's Property. No person, firm, corporation, property owner or occupant shall remove snow or ice from any parcel of real estate and place it upon another parcel of real estate without the express permission of the owner of the parcel of real estate upon which the snow or ice is to be placed.

Section 10. Penalties for Offenses. Any person, firm or corporation that shall violate any sections of this local law shall, upon conviction thereof, be subject to a fine of not more than $100.00 for each offense. Each day that a violation continues shall be considered a separate offense.

Section 11. Severability. Should any section, paragraph, sentence, clause or phrase of this local law be declared unconstitutional or invalid for any reason, the remainder of said local law shall not be affected thereby.

Section 12. When Effective. This local law shall take effect on filing with the Secretary of State as provided by law.

Parking Prohibited During Snow Emergencies

It is prohibited to leave any vehicle parked, standing, unattended or abandoned on any public street or highway within the Village during a snowstorm or after a precipitation of snow of 6 inches or more and continuing to such time as the snow is plowed and removed from the streets by the Department of Public Works.

Zebra Mussels Have Arrived in Otsego Lake

After a delaying action of about four years by the Village boat inspection program, a few zebra mussels have been found at two locations in Lake Otsego. Mussels were identified by experts Tom Horvath and Bill Harman of the SUNY Oneonta Biological Field Station. Lake Otsego was until now the last large body of water in upstate New York which was mussel-free.

Large numbers of zebra mussels can make beaches treacherous for walking, and can clog water intakes of homes and boats. There is no immediate cause for alarm, however. The mussels were small and no clusters were found, so it is unlikely that they will appear in large numbers before about two years. Boat inspections will continue and observations by Field Station personnel will be stepped up.

Lakeside residents and power boat owners are advised to keep alert for growths of the mussels and report them to the biological Field Station at 547-8778. Further information may be obtained by calling the Village Office at 547-2411.
